Effects of this bill
If this bill passes, it means that:
Clients at drug-checking places are exempt from criminal liability for possessing or supplying substances, provided the amount is less than a traffickable quantity.
Drug-checking permit holders and workers are exempt from criminal liability when performing authorized activities, such as receiving, analyzing, and destroying substances.
Permit holders and workers are protected from 'deemed possession' charges for substances found at a drug-checking place while they are working.
Authorized officers can enter drug-checking sites to inspect records, goods, and rooms to ensure the law is being followed.
General drug-checking workers are authorized to provide harm reduction information but cannot possess or analyze substances.
Exemptions for clients do not override existing obligations under bail, parole, or other court and tribunal orders.
