Effects of this bill

If this bill passes, it means that:

The bill raises the age of criminal responsibility from 10 to 12 years. This means that children under 12 cannot be held criminally responsible for their actions. For 12- and 13-year-olds, there is also a presumption against imprisonment, though some exceptions apply based on the severity of the offence.
A tiered diversion scheme is introduced, which aims to reduce formal contact with the criminal justice system. This means young people, where appropriate, are diverted into community-based programs rather than facing prosecution, helping to prevent future offending.
Solitary Confinement is now banned in youth detention
Youth Parole Board will now need aboriginal representation when assessing aboriginal kids’ cases
A pilot program is introduced for electronic monitoring of young people over 14 who are on bail
