Effects of this bill
If this bill passes, it means that:
Institutions are vicariously liable for the abuse of a child by an employee or someone akin to an employee if the role provided the occasion for the abuse.
Independent contractors are not considered individuals akin to an employee of an institution.
People bringing actions for child abuse may do so even if a judgment or dismissal was already made between 13 November 2024 and the start of the Act.
The court can set aside previous settlement agreements, judgments, or orders related to these actions.
The State is the appropriate defendant for claims against public sector bodies that cannot be sued in their own right.
