Effects of this bill
If this bill passes, it means that:
luring or trapping someone using false or misleading representations in order to commit a serious assault or robbery against them is now a criminal offence (up to 5 years imprisonment)
the maximum penalty for publicly threatening or inciting violence against a person or group on grounds of race, religion, sexual orientation, gender identity, intersex or HIV/AIDS status is increased to up to 5 years imprisonment
a new aggravated offence applies when hate-based threats or incitement actually result in violence occurring — maximum penalty 7 years imprisonment
assault or robbery committed as part of a stage performance or similar is still a criminal offence
courts must treat an offence as aggravated if it was motivated by hatred or prejudice based on race, religion, sexual orientation, gender identity, intersex or HIV/AIDS status — demonstrated hatred around the time of the offence is taken as evidence of motivation
